Terms and Conditions

The agreement between you and Kawst for use of the Kawst apps, web app and public pages.

1. Acceptance

These Terms and Conditions ("Terms") are a binding agreement between you and One Kom Labs Technologies LLP ("we", "Kawst"), the company behind the Kawst product. By creating an account, ticking the acceptance box at sign-up, or using any Kawst app, web app or public page, you accept these Terms, the Privacy Policy and the Consent Notice. If you use Kawst on behalf of a business, you confirm you have authority to bind that business, and "you" includes it. If you do not agree, do not use Kawst.

2. Definitions

  1. Platform: the Kawst Android app, the Kawst web app at app.kawst.in, the Kawst Admin app, the public pages at kawst.in, and the servers and APIs behind them.
  2. Owner: a fleet owner or owner-cum-driver account that manages vehicles, drivers, staff, customers and money on the Platform.
  3. Driver: a driver account, whether employed by an Owner, freelance, or seeking work.
  4. Supervisor: a staff account created by an Owner with permissions the Owner assigns.
  5. Vendor / Partner: a cab aggregator, corporate account or another operator that an Owner connects with to exchange trips.
  6. Customer: a person or business that books, is quoted, is invoiced or pays an Owner through a public page.
  7. Plan: the Free, Plus or Pro subscription tier and its limits.
  8. Content: everything you or your staff enter, upload or generate on the Platform.

3. Eligibility and accounts

  1. You must be at least 18 years old and legally capable of contracting in India. Drivers must hold a valid Indian driving licence for the vehicle class they drive.
  2. Accounts are tied to a verified Indian mobile number. Keep your device and OTPs secure; you are responsible for everything done from your account until you tell us it is compromised.
  3. One person, one account. An Owner may add Drivers and Supervisors; those persons hold their own accounts and accept these Terms themselves.
  4. We may refuse, suspend or close an account that breaches these Terms, is used for unlawful activity, or has been inactive for 24 months. We will tell you why unless the law prevents it.

4. What Kawst provides

Kawst is a software tool. It lets Owners record vehicles, drivers and trips; track vehicles and drivers during duty; manage expenses, fuel, maintenance, custody and damage; run attendance, leave and payroll; issue quotations, invoices, receipts and credit notes; collect payments through links; recharge FASTags; connect with partner operators; and hire drivers. It lets Drivers keep a portable record of their work, earnings, licence and ratings, and find jobs. Kawst is not a transport operator, a cab aggregator, an employer of drivers, a lender, a bank, a payment aggregator, or an insurer. Every trip, employment, loan, fare and payment on the Platform is a transaction between the Owner and the other party; Kawst supplies the tools and the records.

5. Plans, fees and billing

  1. Kawst offers a Free plan and paid Plus and Pro plans. Each plan caps the number of vehicles, drivers and vendors and gates certain features. Current limits and prices are shown in the app and may be adjusted with 30 days' notice; a reduction of a limit never applies retroactively to what you already have.
  2. Paid plans are billed monthly or annually (as you choose at checkout) in advance, in Indian Rupees, inclusive of GST, through the web checkout (payment gateway) — not through Google Play. A GST invoice is issued for every charge.
  3. Feature trials are time-limited as shown in the app and end automatically.
  4. Fees are non-refundable except where the law requires or Section 16 applies. If we materially reduce a paid feature, you may cancel and receive a pro-rata refund of the unused period.
  5. If a payment for a paid plan fails, we notify you and you keep full access for 7 days to pay. If it is still unpaid after those 7 days, the account moves to the Free plan and you have 7 days of read-only access (lockout). After that the app is locked until you pay, except live vehicle tracking and critical safety alerts, which stay on until 30 days after the missed payment. Your data is not deleted at any stage, and paying restores your plan.
  6. The Free plan may show advertisements.

6. Payments collected through Kawst

Payment links, invoices and FASTag. When a Customer pays an Owner through a Kawst payment link or invoice page, the Owner is the merchant and the payee. Kawst generates the link and passes the payment to a licensed payment gateway (Razorpay, Cashfree, PhonePe, HDFC SmartGateway or Stripe), which processes it under its own terms and settles to the account the Owner has registered with that gateway. Kawst does not hold, pool or route Customer funds and is not a payment aggregator or a payment system operator under the Payment and Settlement Systems Act, 2007. Gateway fees are disclosed before a link is created. FASTag recharges are fulfilled by A1 Topup under its terms; a flat convenience fee plus the gateway fee is shown before you pay.

Ledger and settlements. The money ledger, vendor settlements, payroll runs and UPI trails in Kawst are records the Owner keeps. Kawst does not move the money they describe. The Owner is responsible for making the payments the ledger records and for the accuracy of the entries.

Refunds and disputes with Customers. A refund of a Customer payment is the Owner's decision and is issued by the Owner through the gateway. Kawst will provide the records needed to resolve a chargeback or dispute.

7. Owners: your responsibilities

  1. Hold every permit, licence, insurance, fitness certificate and PUC the law requires for your vehicles and operations. Kawst's reminders are an aid, not a guarantee.
  2. Comply with all labour, wage, provident fund, ESI, professional tax and other laws that apply to the Drivers and staff you manage. Payroll figures, statutory slabs and payslips are computed from the data and settings you enter; you must verify them, and your chartered accountant remains responsible for your filings.
  3. Inform every Driver and staff member, in writing, that Kawst tracks location during duty, collects motion data if enabled, and can immobilise a fitted vehicle; obtain the consents the Consent Notice describes. Tracking a person outside duty, or without their knowledge, is prohibited and is grounds for immediate termination.
  4. Use Customer data only for the trip, quotation or invoice it was collected for, and honour any request a Customer makes to you under the DPDP Act. You are the Data Fiduciary for your Customers' data; Kawst is your processor under Section 12.
  5. Ensure that any advance or loan you record for a Driver is a private arrangement between you and that Driver. Kawst is not a lender, does not arrange credit, is not a Non-Banking Financial Company, and charges nothing on the amount. You are responsible for complying with any law that applies to the arrangement.
  6. Keep the accounts of Supervisors you create limited to what they need; you are responsible for their actions on the Platform.

8. Drivers: your responsibilities

  1. Drive lawfully and safely. Never interact with the app while driving; use voice or wait until stopped.
  2. Keep your licence, identity and vehicle documents on the Platform accurate and current.
  3. Run trips and duties honestly. Manipulating location, disabling tracking during a duty, or entering false odometer, fuel or expense data may be reported to your employer and may lead to account closure.
  4. Your employment, wages, advances and disputes are between you and your employer. Kawst provides the record and, where your employer enables it, a way to raise a dispute; it does not adjudicate.

9. Location tracking, telemetry and immobilisation

  1. Tracking runs only during a duty or trip and is signalled by a persistent notification on the Driver's phone. Owners see live positions of their own vehicles and on-duty Drivers only.
  2. Hardware trackers are supplied by the Owner or through a Kawst device partner under a separate device agreement. Kawst ingests their data; it is not the manufacturer and does not warrant their accuracy, uptime or fitment.
  3. Immobilisation is available only on compatible trackers, only to the vehicle's Owner or a superior they authorise with a PIN, and only executes once the vehicle has been stationary for a safe interval. The Owner alone decides to immobilise and bears all consequences, including to occupants, cargo, third parties and the vehicle. Immobilising a vehicle in a way that endangers anyone, or as a means of coercion against a Driver, is prohibited. Kawst may refuse or reverse a command it believes unsafe.
  4. Alerts (theft, tamper, geofence, idling, mileage, tow) are best-effort notifications that depend on device connectivity and network availability. Do not rely on them as your sole security or safety measure.

10. Verification, AI and accuracy of data

  1. Licence, identity, RC and FASTag lookups are performed against government and issuer registries through a verification partner. A successful lookup confirms that a record exists and matches the details supplied; it is not a guarantee of a person's character or of a vehicle's condition.
  2. AI-assisted readings of odometer, fuel-bill and damage photos, expense checks, driving-behaviour scores and catalogue images are decision support. They may be wrong. The Owner must review them before acting on them, and no employment or pay decision may rest on an AI output alone.
  3. The vehicle catalogue (makes, models, specifications and images) is compiled from manufacturers' published data and third-party sources and is reviewed by Kawst staff before it goes live. It is provided for convenience and may contain errors; verify specifications against the RC and the manufacturer.

11. Content and intellectual property

  1. You own your Content. You grant Kawst a non-exclusive, royalty-free licence to host, process, display and transmit it as needed to provide the Platform and to generate aggregated, anonymised statistics that cannot identify you or your Customers.
  2. You must not upload Content that is unlawful, infringing, defamatory, or that you have no right to share, and you must not upload malware or attempt to probe, scrape, reverse-engineer or overload the Platform.
  3. The Platform, its code, design, catalogue images and trademarks belong to Kawst and its licensors. You receive a limited, revocable, non-transferable licence to use them for your own fleet operations.
  4. Documents Kawst generates for you — invoices, payslips, quotations, receipts — are yours to use. Kawst branding on public pages may be shown in accordance with your plan.

12. Data protection and processor terms

Kawst is the Data Fiduciary for account holders' personal data and processes it under the Privacy Policy. For personal data an Owner enters about their Customers, Drivers, staff and leads, the Owner is the Data Fiduciary and Kawst is the Data Processor. As processor, Kawst will: process that data only to provide the Platform and on the Owner's documented instructions; implement the security measures in Section 7 of the Privacy Policy; engage only the sub-processors listed in Section 6 of the Privacy Policy and notify Owners 15 days before adding one; assist the Owner with data-principal requests and breach notifications; and delete or return the data at the end of the relationship, save for what the law requires Kawst to keep. Owners must not instruct Kawst to process data unlawfully.

13. Third-party services

Payment gateways, FASTag recharge, identity verification, maps, messaging, hardware trackers and AI services are provided by third parties under their own terms, which you accept when you use those features. Kawst selects and contracts with them carefully but is not liable for their acts, outages or errors beyond re-performing or refunding the affected Kawst service.

14. Availability, support and changes

  1. We aim for the Platform to be available at all times but do not guarantee it. Planned maintenance is announced in the app. Offline mode keeps recent data on your device and syncs when connectivity returns; the server record is authoritative.
  2. Support is available at support@kawst.in and in-app, Monday to Saturday, 10:00 to 18:00 IST. Paid plans receive priority response as described on the pricing page.
  3. We may add, change or retire features. We will give 30 days' notice before removing a feature that a paid plan relies on.
  4. We may update these Terms with 15 days' notice in the app; continued use after the effective date is acceptance. Material changes to your disadvantage entitle you to cancel with a pro-rata refund.

15. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". To the fullest extent the law allows, Kawst disclaims all warranties, express or implied, including fitness for a particular purpose, and does not warrant that the Platform will be uninterrupted, error-free, or that location, telemetry, verification or AI outputs will be accurate. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under Indian law, including under the Consumer Protection Act, 2019.

16. Limitation of liability

Subject to Section 15, Kawst's total liability to you for all claims arising in any 12-month period is limited to the fees you paid to Kawst in that period, or ₹10,000 if you paid none. Kawst is not liable for indirect, consequential or special loss, loss of business, revenue, profit, goodwill or data, or for any loss arising from a decision you took on the basis of tracking, verification, AI or catalogue data, from an immobilisation you ordered, from a third-party service, or from your breach of these Terms or of law.

17. Indemnity

You will indemnify Kawst, its directors, employees and partners against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or of law; your operations, vehicles, trips and employment relationships; your use of tracking or immobilisation; your Content; or a dispute between you and a Driver, Customer, Vendor or authority.

18. Suspension and termination

  1. You may close your account at any time from Profile → Account & role → Delete my account. Paid periods already billed are not refunded except as Section 14 provides.
  2. We may suspend or terminate your account immediately for a serious breach — including unlawful tracking, coercive immobilisation, fraud, abuse of another user, or non-payment — and otherwise on 30 days' notice.
  3. On termination, you may export your data for 30 days; thereafter it is deleted under Section 9 of the Privacy Policy. Sections 6, 11, 12, 15 to 17, 19 and 20 survive termination.

19. Governing law and disputes

These Terms are governed by the laws of India. Before starting formal proceedings, you agree to raise the dispute with our Grievance Officer (Section 20) and to attempt to resolve it in good faith within 30 days. Any dispute not so resolved shall be referred to arbitration by a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996, seated at Bengaluru, Karnataka, conducted in English; the award is final and binding. Subject to arbitration, the courts at Bengaluru, Karnataka have exclusive jurisdiction. Nothing in this Section prevents a consumer from approaching the appropriate Consumer Commission under the Consumer Protection Act, 2019, or either party from seeking urgent injunctive relief.

Notices to you are sent to your registered mobile number, email or in the app. Notices to Kawst must be sent to the email or postal address above.

21. General

  1. These Terms, the Privacy Policy, the Consent Notice and any device or plan agreement you sign are the entire agreement between you and Kawst.
  2. If any provision is held invalid, the rest remain in force. A failure to enforce a provision is not a waiver.
  3. You may not assign these Terms. Kawst may assign them to a successor of its business on notice to you.
  4. Kawst is not liable for delay or failure caused by events beyond its reasonable control, including network outages, government action, natural disaster or the failure of a third-party service.
  5. These Terms are available in English and in the languages the app supports; the English version prevails in case of conflict.
